Welcome to ShopHop, an iOS app for discovering garage sales, estate sales, and single items for sale nearby, and for buying and selling locally ("the Service"). These Terms of Use ("Terms") are an agreement between you and ShopHop ("we," "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
You must be at least 18 years old (or the age of majority where you live) to create an account, post listings, or transact. You are responsible for your account and for keeping your password secure.
ShopHop is a venue that helps neighbors find and post local sales. We are not a party to any transaction between users. We don't own, inspect, or guarantee any item; we don't handle payment between buyers and sellers; and we can't guarantee that any listing is accurate or that any sale will take place. Sales listed from public sources are shown for convenience and may change without notice — confirm details before you travel.
Transactions are completed in person, at the discretion and risk of the people involved. Use good judgment: meet in daylight, in open or public places, bring a friend when you can, and inspect items before paying. A safety guide is shown to every new user and is always available in the app under Profile → Meetup Safety. We do not run background checks and are not responsible for what happens at meetups.
Hosts may promote listings for extra visibility (for example, on the map banner, in Premium Picks, and in the sponsored popup). Promoted placements are labeled as sponsored. Promotion makes a listing more visible; it is not an endorsement by ShopHop, and promotion fees (where charged) are non-refundable once the promotion has run.
You can stop using ShopHop and delete your account at any time in the app. We may suspend or terminate accounts that violate these Terms, abuse other users, or create risk for the community. Sections of these Terms that by their nature should survive termination (such as content licenses, disclaimers, and limitations of liability) survive.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any listing, user, or sale is as described.
To the fullest extent permitted by law, ShopHop will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service or any transaction or interaction with another user. To the extent any liability cannot be excluded, our total liability is limited to the greater of $50 or the amount you paid us in the twelve months before the claim.
You agree to indemnify and hold ShopHop harmless from claims arising out of your listings, your content, your transactions, or your violation of these Terms or applicable law.
We may update the Service and these Terms. If changes are material, we will update this page and the "Last updated" date, and notify you in the app when appropriate. Continuing to use ShopHop after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Colorado, and you consent to their jurisdiction.
